1. Agreement

By using Dily Pro (the mobile app, the web dashboard, or the customer-facing card page), you agree to these Terms of Use. If you do not agree, do not use the service.

Dily Pro is operated by Dily, based in Belgium. These terms are governed by Belgian law.

2. The service

Dily Pro is a digital loyalty system for local businesses. It includes:

  • A mobile app for merchants to scan customers, manage stamps/points, view analytics, and manage team members
  • A web-based loyalty card for end customers, accessible via QR code without downloading an app
  • A landing page and admin tools for business setup

3. Account registration

To use Dily Pro as a merchant, you need an account created by the Dily team. Business accounts are set up manually after contact with us.

Team members are invited by the business owner and sign in via Google or Apple. Customers sign in via Google or Apple to access their loyalty card.

You are responsible for maintaining the security of your account and for all activity that occurs under it.

4. Pricing and billing

Dily Pro costs €9,99 per month (excl. VAT). Billing is handled manually via invoice.

  • There is no contract. You can cancel at any time
  • Invoices are sent monthly
  • If an invoice remains unpaid for more than 30 days, we may suspend your account
  • We reserve the right to change pricing with 30 days notice

5. Acceptable use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to access accounts or data belonging to other businesses
  • Reverse engineer, copy, or redistribute the Dily Pro software
  • Use the service to send spam or unsolicited communications
  • Abuse the stamp/point system in a way that misleads customers
  • Upload harmful content, viruses, or malicious code

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your data

You own your data. All business data, customer information, and loyalty program data belongs to you. We process it only to provide the service.

We do not sell, share, or trade your data with any third party. See our Privacy Policy for full details.

7. Customer data

As a merchant using Dily Pro, you may process personal data of your customers (names, emails, stamp progress). You are responsible for:

  • Informing your customers that you use a digital loyalty system
  • Handling customer data requests (access, deletion) in collaboration with us
  • Not using customer data collected through Dily Pro for purposes outside the loyalty program

8. Availability

We aim to keep Dily Pro available at all times, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to:

  • Scheduled maintenance (we will notify you in advance when possible)
  • Unexpected technical issues
  • Third-party service outages (hosting, authentication providers)

We are not liable for any losses resulting from service downtime.

9. Intellectual property

The Dily Pro name, logo, app, website, and all associated software are the intellectual property of Dily. You may not copy, modify, or redistribute any part of the service without written permission.

You retain ownership of all content you upload (logos, branding, offer text). By uploading content, you grant us a license to display it within the service.

10. Account termination

You can cancel your account at any time by contacting us at [email protected].

Upon cancellation:

  • Your loyalty program will be deactivated
  • Customer cards linked to your business will no longer be accessible
  • Your data will be deleted within 30 days

We may terminate your account if you violate these terms, with or without notice.

11. Limitation of liability

Dily Pro is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by Belgian law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not responsible for lost revenue, lost customers, or missed stamps due to service issues

12. Changes to these terms

We may update these terms from time to time. We will notify you of significant changes by email or through the service. Continued use of Dily Pro after changes constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of Belgium. Any disputes will be resolved in the courts of Belgium.
